1. Agreement
By accessing codesamurai.ai, using an embed or chatbot hosted by us, or otherwise using our AI platform services, you agree to these Terms of Use. If you do not agree, do not use the platform.
2. The service
Code Samurai provides hosted AI tools (including the Code Samurai Chatbot) operated from codesamurai.ai. Tools are typically provisioned by Code Samurai for a customer website and connected through a lightweight customer plugin or embed. Product information is available on www.codesamurai.com/ai-chatbot/.
Features, plans, and availability may change as we improve the platform. Self-serve signup and customer portals may not be available.
3. Accounts and access
Operator and admin access to platform controls is provided to authorized Code Samurai personnel and, where applicable, designated customer contacts. You are responsible for safeguarding credentials issued to you and for activity under your access.
4. Customer responsibilities
If you use our tools on your website, you are responsible for:
- Content on your site that is indexed or used as chatbot knowledge
- Your branding, disclosures, consent copy, and privacy links shown to visitors
- Lead forms and personal data stored on your WordPress site
- Compliance with laws that apply to your business and your visitors (including marketing and privacy rules)
- Not using the service for unlawful, harmful, or abusive purposes
5. Visitor use of chat
Chat tools are AI assistants for general website information. They are not live human agents and do not provide professional legal, medical, financial, or other regulated advice. Do not submit sensitive personal, financial, health, or confidential information into chat.
6. Acceptable use
You agree not to:
- Attempt to disrupt, overload, reverse engineer, or unauthorizedly access the platform
- Use the service to send spam, malware, or deceptive content
- Infringe intellectual property or privacy rights of others
- Bypass security, plan limits, or consent/bot-protection controls
- Misrepresent the chatbot as a human or as providing professional advice
We may suspend or terminate access for violations or to protect the platform and its users.
7. Intellectual property
The platform, software, designs, and Code Samurai branding are owned by Code Samurai or its licensors. Customers retain rights to their own website content. You grant us a limited license to host, process, and display content as needed to provide the configured tools (including knowledge indexing and chat responses).
8. Third-party services
The platform relies on third-party services such as hosting, security (including Cloudflare Turnstile), and AI providers. Those services are subject to their own terms and privacy practices.
9. Disclaimers
THE PLATFORM AND TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted service, error-free AI outputs, or that answers will be complete or accurate.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODE SAMURAI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM USE OF THE PLATFORM OR TOOLS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF NO SUCH FEES WERE PAID).
11. Indemnity
If you are a customer, you agree to defend and indemnify Code Samurai against claims arising from your website content, your visitors’ use of tools you deploy, your lead handling, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
12. Separate agreements
Statements of work, proposals, hosting agreements, or other written contracts with Code Samurai control if they conflict with these Terms for that engagement. Sales and billing for agency services are handled through www.codesamurai.com processes unless otherwise agreed.
13. Changes
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law.
14. Governing law
These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law rules, unless a separate written agreement specifies otherwise. Courts located in Indiana will have exclusive jurisdiction over disputes arising from these Terms, subject to applicable law.
